How to file for divorce in California: a step-by-step guide

Filing for divorce in California feels overwhelming because the system is built for lawyers, not people. This guide walks you through the real steps so you know what’s coming.

1. Confirm you meet residency requirements

To file in California, at least one spouse must have lived in the state for the past 6 months and in the county where you file for the past 3 months.

2. Decide the type of divorce

  • Summary dissolution — a faster track for short marriages with no kids and limited assets.
  • Standard dissolution — what most divorces look like.

3. File the petition (Form FL-100)

This is the document that officially opens your case. You’ll also file a summons (FL-110) and, if you have kids, a UCCJEA declaration (FL-105).

4. Serve your spouse

Your spouse must be formally notified — not by you personally. Most people use a process server or the sheriff.

5. Exchange financial disclosures

California requires both spouses to share full financial information. Skipping or fudging this step is the fastest way to wreck your case.

6. Reach an agreement — or go to court

Most California divorces settle through negotiation or mediation. Going to trial is the exception, not the rule.

7. The 6-month waiting period

California requires a minimum of 6 months from the date of service before the divorce can be finalized. Plan accordingly.
